1. Acceptance of Terms
These Terms of Service govern your access to and use of the KRASKII website, online booking system, and in-studio services, operated by KRASKII, located in California.
By booking an appointment, submitting a deposit, visiting our website, or receiving any service from us, you ("Client," "you") agree to be bound by these Terms. If you do not agree, please do not book an appointment or use our Services.
You must be at least 18 years old to book or receive any service from KRASKII. We do not perform permanent makeup, tattooing, or body art services on minors under any circumstances, including with parental or guardian consent.
2. Description of Services
KRASKII provides permanent cosmetic and beauty services, which may include:
- Powder brows, and other permanent/semi-permanent eyebrow techniques
- Lip blushing and lip pigmentation
- Brow shaping and tinting
- Waxing services
Not every service listed on our website or social media is guaranteed to be available at all times. We reserve the right to add, discontinue, or modify any service, and to update pricing, at any time.
Permanent makeup and micropigmentation are forms of tattooing. These procedures involve implanting pigment into the skin using a needle and are governed in California by the Safe Body Art Act (California Health & Safety Code §§ 119300 et seq.). KRASKII and its practitioners are registered and operate in compliance with that Act, including practitioner registration, facility permitting, bloodborne pathogens training, and sterilization/sanitation requirements.
3. Eligibility & Candidacy
Permanent makeup and body art services are not appropriate for everyone. By booking a service, you confirm that you meet our candidacy requirements, which include (but are not limited to):
You may be a candidate if you:
- Are 18 years of age or older
- Do not have a skin or medical condition that affects candidacy (see below)
You are generally not a candidate, and we may decline or postpone your service, if you:
- Are pregnant or nursing (nursing clients should wait until fully finished nursing)
- Are prone to keloid scarring, or have active rashes, blisters, eczema, or psoriasis in the treatment area
- Have a transmittable blood condition (e.g., Hepatitis, HIV)
- Have glaucoma or are taking blood-thinning medication, without medical clearance
- Are currently taking Accutane or a similar retinoid
- Are epileptic with a history of fainting or seizures, without medical clearance
- Are diabetic or have a heart condition, without a doctor's written clearance
- Have any other condition disclosed in our required medical intake/consent form that our practitioner determines makes the procedure unsafe
We reserve the right to decline service, refuse to proceed, or stop a procedure at any time if, in our practitioner's professional judgment, it is not safe to continue. Deposits are not refunded when a service is declined or discontinued due to a client's non-disclosure or misrepresentation of a disqualifying condition (see Section 5).
4. Booking, Deposits & Payment
- Appointments are booked and paid for through our booking partner, Stripe. By booking, you also agree to Stripe's applicable terms for payment processing.
- A non-refundable, non-transferable deposit of $100 (for full treatments) is required to reserve any appointment. This deposit is applied toward the cost of your first treatment.
- Full payment for services is due at the time of your appointment unless otherwise agreed in writing.
- Touch-up appointments, if applicable, are scheduled separately (generally 4–12 weeks after an initial appointment) and are not included in the cost of your initial service unless explicitly stated at booking.
- Prices are subject to change without notice; the price confirmed at the time of booking or invoicing will apply to that appointment.
Cancellations & Rescheduling
- We require at least 48 hours notice to reschedule or cancel an appointment without losing your deposit.
- Late cancellations, no-shows, or failure to follow pre-care instructions (Section 7) resulting in a required reschedule may result in forfeiture of your deposit and a requirement to pay a new deposit to rebook.
- Arriving more than 15 minutes late may be treated as a no-show at our discretion.
5. Informed Consent, Assumption of Risk & Release
Permanent makeup and body art procedures carry inherent risks. Before any procedure, California law (Health & Safety Code § 119303) requires you to read, complete, and sign a separate written informed consent form, which will include, at minimum:
- A description of the procedure and the equipment/products used
- A statement that the results are permanent or semi-permanent in nature
- Notice that tattoo inks, dyes, and pigments have not been evaluated or approved by the U.S. Food and Drug Administration, and that their long-term health effects are not fully known
- Post-procedure care instructions and signs/symptoms that may require medical attention
- Health screening questions (including pregnancy status and bloodborne pathogen risk factors)
You must complete and sign this consent form in person before your procedure.
By booking and receiving a service, you additionally acknowledge and agree that:
- Results vary. Healed results, color retention, symmetry, and longevity depend on your individual skin type, lifestyle, sun exposure, aftercare compliance, and how your body retains pigment. Results typically last 1 to 3 years and will fade over time. We make no guarantee of a specific outcome, exact color match, or specific duration of results.
- Touch-ups may be required to achieve or maintain your desired result, at additional cost unless otherwise stated.
- Risks of the procedure may include, without limitation: infection, allergic reaction, asymmetry, uneven pigment retention, color changes over time (including undertone shifts), scarring, and dissatisfaction with the aesthetic outcome. Some of these risks cannot be fully eliminated even when all safety and sanitation protocols are followed correctly.
- You have disclosed all relevant medical history, allergies, medications, and skin conditions truthfully and completely. Providing false or incomplete information may affect your candidacy and may void any responsibility we would otherwise bear for an adverse outcome.
- To the fullest extent permitted by California law, you release KRASKII, its owner, practitioners, and staff from liability for outcomes that result from undisclosed medical conditions, failure to follow pre-care or aftercare instructions, or the inherent risks of permanent makeup procedures described above and in your signed consent form.
6. Pre-Care & Aftercare Compliance
You are responsible for following all pre-care and aftercare instructions provided to you before and after your appointment (including any instructions on our website's Appointment Prep page). Failure to follow these instructions:
- May affect your results, healing, and pigment retention, for which KRASKII is not responsible;
- May require you to reschedule your appointment and may result in forfeiture of your deposit;
- Is done at your own risk with respect to complications such as infection or poor pigment retention.
Please note that healing timelines are approximate — typically up to two weeks for brows and 5–7 days for lip services — and vary by individual.
7. Photography & Marketing Consent
Unless you opt out in writing (email us at browsbykraskii@gmail.com or notify us in person before your appointment), you agree that KRASKII may photograph or video your treatment area (before, during, and after your procedure) and use these images for marketing purposes, including our website, social media, and portfolio, without additional compensation to you. We will not publish images that include your face or other identifying features without your separate, explicit consent, unless you have agreed otherwise.
You may withdraw this consent at any time for future use of your images by contacting us, though we cannot retract material already published or shared by third parties prior to your request.
8. Studio Policies
- No children or additional guests are permitted in the treatment room during appointments, for hygiene, safety, and confidentiality reasons, unless otherwise approved in advance.
- Please arrive with your brows/lips in their natural, everyday state as instructed for your specific service (e.g., brows filled in as usual) so your practitioner can assess your natural shape and habits.
- We reserve the right to refuse service to anyone for any lawful reason, including safety concerns, disruptive behavior, or failure to comply with these Terms.
9. Refund Policy
Because permanent makeup and body art services are personalized, immediately performed, and cannot be "returned," all services rendered are non-refundable. Deposits are non-refundable and non-transferable as described in Section 4.
If you are unhappy with your results, please contact us at browsbykraskii@gmail.com so we can discuss a touch-up, correction, or other resolution at our discretion. This section does not affect any non-waivable rights you may have under California consumer protection law.
10. Website Use & Intellectual Property
All content on the KRASKII website — including text, images, logos, graphics, and design — is owned by KRASKII or its licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written consent.
You agree to use our website and booking system only for lawful purposes and not to interfere with their operation, attempt unauthorized access, or submit false or misleading information when booking.
11. Limitation of Liability
To the fullest extent permitted by California law, KRASKII, its owner, practitioners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Services, even if advised of the possibility of such damages.
Our total liability for any claim arising from a service shall not exceed the amount you paid for that specific service. This limitation does not apply to liability that cannot be limited or excluded under California law, including for gross negligence or willful misconduct.
12. Indemnification
You agree to indemnify and hold harmless KRASKII and its owner, practitioners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your provision of false or incomplete health information, or your failure to follow pre-care or aftercare instructions.
13. Privacy
Your personal and health information is handled in accordance with our [Privacy Policy] and, where applicable, the federal Health Insurance Portability and Accountability Act (HIPAA) and the California Consumer Privacy Act (CCPA/CPRA), as required under the Safe Body Art Act's handling of medical intake information. 14. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or our Services shall be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
15. Changes to These Terms
We may update these Terms from time to time. The "Effective Date" at the top will reflect the most recent revision. Continued use of our Services after changes are posted constitutes your acceptance of the updated Terms.
16. Severability & Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with your signed informed consent form and our Privacy Policy, constitute the entire agreement between you and KRASKII regarding your use of our Services.
